Platform terms
A summary of the terms that govern use of the FortyFive platform by businesses, engineers and delivery partners.
Last updated:
The full platform terms are provided to each organisation when it signs up and form part of its agreement with FHBM LIMITED. This page summarises what they cover so you know what to expect.
The parties
FortyFive provides the platform. Businesses use it to commission and manage field work. Engineers and delivery partners use it to accept and deliver that work. Engineers and partners are independent businesses using the platform; they are not employees or agents of FortyFive or of the businesses commissioning work.
The service
FortyFive provides tools to define jobs, offer and accept work, capture evidence, review and approve delivery, and prepare commercial records and invoices. FortyFive does not carry out field work and is not responsible for how it is performed. The business commissioning work remains responsible to its own customer.
Accounts and conduct
Users must provide accurate information, keep credentials secure and follow the acceptable-use rules. Customers may require checks such as certifications, insurance or right-to-work documents before work is offered. FortyFive may suspend or remove accounts for serious or repeated breaches, fraud, or conduct that puts others at risk.
Delivery records
Evidence and approvals are recorded against each job and kept tamper-evident: corrections are recorded rather than overwritten. Each customer’s data is kept separate from every other customer’s.
Fees and payment
Subscription and transaction fees are set out in each organisation’s order or plan. Free plans may require pre-funding before jobs are released. Payment, factoring and extended-terms services are planned; when introduced they will be offered under separate terms, subject to eligibility and, where relevant, our finance partners’ approval.
Non-circumvention
Where a business and an engineer or partner are first introduced through the platform, both agree not to move that work off the platform to avoid fees for a defined period. This obligation applies equally to both sides.
Data protection
FortyFive processes customers’ operational data as their processor under the data processing agreement, and is controller of platform-level data such as accounts and ratings, as described in the privacy policy.
Liability, disputes and law
The terms set out each party’s liability, limits and indemnities, how disputes are handled, and the governing law (England and Wales).
